Terms & Conditions

    1. DEFINITIONS

    For the purpose of this agreement ‘Photographs’ means all photographic material furnished by the Photographer, whether transparencies, negatives, prints or any other type of physical or electronic material, ‘Videos’ / ‘Movies’ means all motion video footage including its soundtrack created by Keylight and supplied on any form of physical or online media.  A ‘booking’ is defined only by payment of a deposit set against an agreed date, in writing and is not transferrable between dates. A ‘Service Package’ / ‘Service Booking’ is defined as an agreed product or service requested by you, to be provided by Keylight Photography on any specified date. ‘Photographer’ means the man or woman operating photographic or video equipment during your Service Booking.

    1. WHAT YOU PAY FOR & RECEIVE

    Is to be agreed in advance by selecting the appropriate photography / videography package and (if required) additional products and items.

    1. COPYRIGHT

    It is our policy to give full Copyright Ownership to our customers (you / the recipient) to allow you to reprint, enlarge, copy and publish and sell any Photography prepared by Keylight Photography.  Keylight reserves the right to use any material for reproduction and advertising purposes.  A Copyright Ownership Certificate will be given, upon completion of all work.

    1. REQUESTED PHOTOGRAPHS

    The Photographer cannot be held responsible for lack of coverage caused by any member of the group or wedding party not being on time, or by Church, Register Office or Licensed Place imposing photography / videography restrictions. The photographer does not guarantee to undertake any specific picture, group arrangement, background or location although they  will strive to honour all photographs requested and agreed in advance. The photographer cannot be held responsible for weather disturbances affecting coverage although all efforts will be taken to provide agreed coverage in the time allocated to them.

    1. MATERIALS

    All photographs are edited / printed to produce pleasing skin tones. Some clothing shades can be extremely difficult to accurately reproduce. If colour matching is crucial the client should provide a swatch before processing takes place.

    1. EXCLUSIVITY

    The Photographer retains the right in all cases to use the Photographs at any time and in any part of the world for the purposes of advertising or otherwise promoting their work.

    1. USE

    The Licence to Use comes into effect upon receipt of full payment of your Service Package.  You, the client / customer, are licensed to use your Photographs / Videos in any way you see appropriate, in agreement that you are the holder of the Copyright Ownership Certificate.  Keylight Photography will not be responsible for any such uses.

    7a. WEATHER

    Should it rain on the day, the Bride, Groom & Photographer / Videographer can return to the venue to perform a retro-shoot. This is included  free of charge in all Wedding Services as a personal guarantee and to offer peace of mind to ensure you get the outdoor images and footage you hope for.  In instances where there is a large distance to travel, between Keylight and the venue, basic travel expenses may be required.  This may be the only additional cost to perform a ‘Weather Retro-Shoot’. Keylight is not responsible for the recreation or maintenance of materials to be performed as part of a Retro-Shoot, including things such as, and not limited to, dry-cleaning, hair & makeup, flower bouquets, suit hire, venue hire etc. Keylight only provides coverage for photographs and video recording.

    1. CLIENT CONFIDENTIALITY

    The Photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to him/her in confidence for the purposes of the photography / videography, save as may be reasonably necessary to enable the Photographer / Videographer to carry out his/her obligations in relation to the commission, and/or for the use of photographs / video footage as advertising for Keylight.

    1. INDEMNITY

    In the highly unlikely event of total photographic failure (by equipment or processing, or non attendance of the photographer) the Photographer’s liability shall be limited to a full refund of monies paid at that time.  Keylight is also insured for professional indemnity and public liability.

    1. BOOKING , PAYMENT, CANCELLATION &

    POSTPONEMENT

    A deposit of £300 is payable at the time of booking. This deposit is not returnable except in the event of the Photographer cancelling the commission. A booking is considered firm on receipt of the signed Booking Form and/or deposit. Both parts are required, however, payments made also determines Proof of Contract in the absence of signed paperwork.  Balance of payment is due 14 days before the wedding day. Payments made cannot be refunded except where cancellations are made by Keylight.  Subsequent orders for prints and video are to be paid for in advance. All processing costs are charged at the prevailing rate at the time the materials arrive at the processing laboratory.  All cancellations must be made in writing.  Postponements made by the customer are counted as Customer Cancellations. Should you wish to cancel your booking; If the Agreed Booking date is more than 6 months away (6 months and 1 day inclusive) your deposit will be forfeited and an additional fee of £350, or the remaining balance of the booking (whichever is the least) must be paid upon receipt of cancellation.  If the Agreed Booking date is less than 6 months away from receipt of cancellation, full payment is required to the total balance of your Service Package,    minus any deposits previously paid and minus any non-incurred expenses by Keylight (travel  & accommodation costs etc.).

    1. EXPENSES

    The Photographer is liable for any expenses incurred during your Service Booking, unless otherwise stated, which are directly affective to their own travel / materials and refreshments etc.  Keylight Photography calculates the ‘total balance due’ to include such expenses and therefore additional costs are usually not required.

    1. REJECTION

    There is no right to rejection on the basis of style or composition.

    1. ELECTRONIC STORAGE

    Photographs & Videos prepared by Keylight Photography can be stored in any media format you so wish, in line with section 3 of this Terms and Conditions notice.  Various formats are available on request and usually include DVD / CD-Rom, USB memory.

    1. FORCE MAJURE

    In the event of any and all matters and circumstances outside of the control of Keylight, including, and not limited to, local and national emergencies, acts of nature, fire, earthquakes, lightning damage, flooding, energy outages, medical and other pandemics and government/authority sanctioned actions, quarantines, venue closures, supplier bankruptcies not including Keylight, and reasons for cancellations and postponements that are not by Keylight, resulting in Keylight not being able to carry out its role within the agreed contract, the rules set out within Section 10 will apply.  Wherever possible, in these circumstances set out in Section 14, Keylight will make every effort to move your agreed date to a new available date, only where circumstances within Section 14 shall apply, but will not be responsible for dates being altered by the client/customer as ‘postponements’ if not agreed with Keylight, for example if a client changes their date without checking availability with Keylight.

    1. 15. CONSUMER INSURANCES

    Keylight always recommends that clients / customers obtain their own private Insurances, such as ‘Weddings & Events Insurance’ to cover eventualities such as those described in Section 14, allowing for monies paid to Keylight to be reimbursed to the client / customer, by the Insurance Company, upon presentation of your receipt of payment, to your Insurance Company.  The onus for arranging these belongs to the client / customer.

    1. 16. APPLICABLE LAW

    The laws of England & Wales shall govern this agreement. These Terms and Conditions shall not be varied except by agreement in writing.
